Not all conservatorships are for the elderly or incapacitated

Many people here in California remember when performer Britney Spears had an apparent breakdown when she attacked a car with an umbrella after shaving her head. Since that incident in 2008, Spears’ father has been in control of her life and finances. She is a prime example of the fact that people do not have to be incapacitated or elderly to benefit from conservatorships.

Now, however, Spears feels as though she has reached a place in her life where she can make her own decisions when it comes to her personal life. Reports indicate that her father no longer lives with her, and he has given her more freedoms over the years. She is said to have no objection to her father handling her money, however.

Some speculate that she is ready, or nearly ready, to ask that the conservatorship be terminated. In order to end the personal conservatorship, she will need to show that she can handle herself. The opinions of her father and doctors will weigh heavily in the decision of whether to grant her request. This is the issue many people under a conservatorship face — they may feel on the defensive when it comes to ending the arrangement.

California residents who are under conservatorships that they believe should end often find themselves struggling. The courts are cautious when it comes to ending these arrangements, and for good reason. However, if the conservator and others do not share the ward’s belief, an uphill battle may commence. In some cases, the conservator may have ulterior motives in keeping his or her position. It may take the help of an attorney to present the appropriate evidence to the court.
